Terms of Use

Welcome to the Elevé Odor Specialists website. This website is owned and operated by ALL-STARS TX LLC, DBA Elevé Odor Specialists ("Elevé," "Company," "we," "us," or "our").

These Terms of Use govern your access to and use of eleveodorspecialists.com, including information concerning the Elevé Odor Specialists independent contractor network, contractor applications, equipment and training programs, territory opportunities, and related services.

By accessing or using this website, you agree to these Terms of Use. If you do not agree with these Terms, please do not use this website.

1. Purpose of This Website

The Elevé Odor Specialists website provides information about opportunities for qualified individuals and businesses to apply to participate in the Elevé Odor Specialists independent contractor network.

The website may provide information concerning:

  • The contractor business model

  • Contractor compensation

  • Services performed through the network

  • Equipment and training requirements

  • Contractor responsibilities

  • Company support

  • Market and territory availability

  • Application and qualification procedures

  • Contractor onboarding

Information provided on this website is for general informational and application purposes and may be modified as the contractor program develops.

2. No Employment Offer

Nothing contained on this website constitutes an offer of employment.

Elevé Odor Specialists operates an independent contractor network. Applicants who are ultimately approved and activated are expected to operate as independent contractors subject to the terms of a separate written Independent Contractor Agreement.

Submitting an application, participating in an interview, completing training, purchasing or obtaining equipment, or otherwise participating in the qualification process does not create an employer-employee relationship.

3. No Contractor Relationship Created by Website Use

Accessing this website or submitting a contractor application does not create an independent contractor, employment, agency, partnership, joint venture, franchise, fiduciary, or other business relationship between you and ALL-STARS TX LLC or Elevé Odor Specialists.

A contractor relationship is established only after the applicant has satisfied applicable screening, qualification, documentation, insurance, agreement, onboarding, equipment, training, and readiness requirements, received final approval, entered into the required written agreement with the Company, and been activated by the Company.

4. Contractor Applications

Applicants are responsible for providing accurate, current, and complete information during the application and qualification process.

We reserve the right to:

  • Accept or decline applications

  • Request additional information

  • Verify information submitted by applicants

  • Conduct screening, interviews, or qualification reviews

  • Require background screening where applicable

  • Require documentation and insurance verification before activation

  • Evaluate market and territory availability

  • Require execution of applicable contractor agreements and acknowledgments

  • Establish onboarding, equipment, training, safety, and operational requirements

  • Suspend or discontinue an application

  • Modify qualification standards as business needs evolve

Submission of an application does not guarantee approval or activation.

We may decline an application when a market is unavailable, sufficiently staffed, temporarily closed to additional contractors, or otherwise not appropriate for additional contractor activation.

5. Compensation Structure

The website may describe the current contractor compensation model, including a structure under which a contractor may receive 55% of applicable collected service revenue and the Company retains 45%, subject to the applicable Independent Contractor Agreement and authorized adjustments.

Customer tips are separate from the 55%/45% revenue allocation. Under the current contractor program, 100% of customer tips are allocated to the contractor who performed the applicable service, subject to payment-processing, chargeback, fraud, refund, or other circumstances addressed in the applicable contractor agreement or policy.

This information describes the current contractor program and is not a guarantee of earnings.

Specific compensation terms, calculation methods, deductions or adjustments where applicable, payment procedures, and other financial terms will be governed by the applicable Independent Contractor Agreement and related contractor policies.

If information on this website differs from an executed Independent Contractor Agreement, the executed agreement controls.

6. No Guarantee of Earnings or Customer Volume

Elevé Odor Specialists does not guarantee any contractor:

  • Minimum income

  • Specific earnings

  • Minimum number of jobs

  • Customer volume

  • Frequency of assignments

  • Revenue level

  • Profitability

  • Business success

  • Return on investment

  • Particular market demand

Actual contractor results may vary substantially based on factors including location, customer demand, availability, performance, market conditions, service quality, scheduling, customer satisfaction, operational expenses, and other factors.

Any examples, illustrations, estimates, projections, or descriptions appearing on the website should not be interpreted as promises or guarantees of future performance.

7. Markets and Territories

The Company may organize contractor operations by geographic markets, ZIP codes, service areas, or other geographic boundaries.

Market or territory availability displayed, checked by ZIP code, or discussed during the application process is subject to review and change as customer demand, contractor capacity, operational needs, and territory status change.

Submitting an application for a particular location does not reserve, assign, or guarantee that location.

No applicant receives an exclusive or protected territory merely by applying, completing training, purchasing equipment, or communicating with the Company.

Any territory rights, limitations, protections, or operating boundaries applicable to an approved contractor will be governed by the contractor's written agreement and Company policies.

8. Equipment and Training Requirements

Approved contractors may be required to obtain designated equipment, supplies, training, branding materials, protective equipment, and other materials before activation.

The website may display current equipment and training packages, including current or starting prices.

The contractor program currently offers five professional equipment packages, starting at $2,895.

Package contents, equipment specifications, availability, vendors, shipping costs, taxes, training requirements, fulfillment details, and pricing may change.

The final equipment and training requirements applicable to an applicant will be communicated and confirmed during qualification and onboarding before purchase.

Unless expressly stated otherwise in writing, purchasing equipment or completing training does not guarantee contractor approval, activation, job assignments, earnings, or territory rights.

9. Independent Business Expenses

Approved independent contractors may be responsible for expenses associated with operating their independent businesses as specified in their contractor agreements.

Depending on the contractor arrangement, such expenses may include transportation, insurance, taxes, licenses, permits, communications, business expenses, equipment maintenance, supplies, and other operating costs.

Applicants should independently evaluate the costs and risks associated with operating an independent business before proceeding.

10. Contractor Classification and Taxes

Approved contractors are intended to operate as independent contractors and not as employees of ALL-STARS TX LLC or Elevé Odor Specialists, subject to applicable law and the governing written agreement.

Independent contractors are generally responsible for their own federal, state, and local tax obligations and other responsibilities associated with operating an independent business.

Nothing on this website constitutes legal, accounting, tax, financial, or investment advice.

Applicants should consult their own professional advisors regarding their individual circumstances.

11. Contractor Standards

Approved contractors may be required to comply with applicable network standards concerning matters such as:

  • Training and certification

  • Equipment

  • Branding

  • Customer communication

  • Scheduling

  • Service procedures

  • Safety

  • Documentation

  • Professional conduct

  • Customer service

  • Reporting

  • Payment procedures

  • Quality standards

Specific requirements applicable to approved contractors will be governed by their agreements, training materials, policies, and operational procedures.

12. No Franchise Offering

Nothing on this website is intended to constitute the offer or sale of a franchise.

Participation in the Elevé Odor Specialists contractor network is subject to the Company's independent contractor structure and applicable written agreements.

Nothing on this website should be interpreted as granting ownership of the Elevé Odor Specialists or Best Odor Removal brands, trademarks, systems, customer relationships, or other intellectual property.

13. Intellectual Property

Unless otherwise stated, website content—including text, graphics, logos, branding, photographs, designs, training references, business materials, and other content—is owned by or licensed to ALL-STARS TX LLC.

The names and branding associated with Elevé Odor Specialists and Best Odor Removal, together with associated logos and materials, may not be copied, reproduced, modified, distributed, displayed, or used for commercial purposes without authorization.

Approved contractors may receive limited rights to use designated branding or materials pursuant to their contractor agreements and Company policies.

14. Acceptable Website Use

You agree not to:

  • Use the website for unlawful purposes

  • Submit false or misleading information

  • Attempt to gain unauthorized access to website systems or contractor portals

  • Interfere with website security or functionality

  • Introduce malicious software or harmful code

  • Scrape, harvest, or systematically extract website information without authorization

  • Impersonate another person or business

  • Misuse Company trademarks, branding, content, or intellectual property

We may restrict access when we reasonably believe the website or application process is being misused.

15. Contractor Portal

Certain website features, the Elevé Odor Specialists Operations Hub, and contractor portal functions are available only to authorized users, approved applicants, or activated contractors, depending on the feature and stage of the contractor process.

Contractor and applicant login credentials are intended solely for the authorized person to whom they are issued and should not be shared.

Access to an applicant, onboarding, or contractor portal does not itself create or alter a contractor, employment, territory, customer, or other business relationship. Any contractor relationship is governed by the applicable Independent Contractor Agreement and related written policies.

The Company may suspend or terminate portal access as permitted by applicable agreements or when reasonably necessary for security or operational purposes.

16. Third-Party Services

This website may link to or integrate with third-party services used for applications, scheduling, payments, training, communications, equipment fulfillment, contractor management, or other business functions.

Third-party services operate according to their own terms and privacy practices.

ALL-STARS TX LLC is not responsible for the availability, security, content, or independent practices of third-party services except to the extent required by applicable law.

17. Website Information and Availability

We attempt to provide accurate and useful information, but website content may occasionally contain errors, omissions, outdated information, or technical issues.

Contractor program details, market availability, pricing, equipment requirements, compensation structures, policies, and other information may change.

We may modify, suspend, or discontinue any portion of the website or contractor application process at any time, subject to applicable contractual and legal obligations.

18. Disclaimer of Warranties

To the extent permitted by applicable law, this website and its content are provided on an "as is" and "as available" basis.

We do not warrant that the website will always be uninterrupted, error-free, completely secure, or free from harmful components.

Nothing on this website constitutes a warranty or guarantee concerning contractor approval, business opportunities, customer demand, earnings, profitability, or results.

19. Limitation of Liability

To the fullest extent permitted by applicable law, ALL-STARS TX LLC and its affiliates, officers, representatives, and service providers will not be liable for indirect, incidental, special, consequential, or similar damages arising solely from your use of or inability to use this website.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Rights and obligations arising from an executed contractor agreement will be governed by that agreement rather than this website provision.

20. Privacy

Use of this website is also subject to our Privacy Policy, which explains how information submitted through the website and contractor application process may be collected, used, maintained, and disclosed.

21. Changes to These Terms

We may revise these Terms of Use periodically to reflect changes to our website, contractor program, business practices, technology, or legal requirements.

Updated Terms will be posted on this page. Continued use of the website following publication of revised Terms constitutes acceptance to the extent permitted by applicable law.

Material changes affecting an existing contractor's contractual rights will be governed by the applicable contractor agreement and applicable law.

22. Governing Law

These Terms of Use are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise.

These website Terms do not replace or modify any governing-law, venue, dispute-resolution, mediation, or arbitration provisions contained in an executed Independent Contractor Agreement.

23. Entire Website Terms

These Terms and the Privacy Policy govern use of this website.

For approved contractors, the applicable Independent Contractor Agreement and related written agreements and policies control the contractor relationship. If there is a conflict between general website information and an executed contractor agreement, the executed agreement will control with respect to the contractor relationship.
